Instruments du Monde Shipping Policy

ARTICLE 1. PURPOSE
The purpose of this shipping policy is to define the terms and conditions applicable to the shipment of a Product to the Customer by the Publisher.
ARTICLE 2. PARTIES
This shipping policy applies between Instruments du Monde, SAS, registered with the Paris Trade and Companies Register in France under number 951155779, head office: 14 avenue de l'Opéra 75001 PARIS, FR, telephone: +33176214462, email: secretariat@instruments-du-monde.com, intra-Community VAT number: FR16951155779, hereinafter referred to as “the Publisher,” and any person, natural or legal, under private or public law, registered on the Site to purchase a Product, hereinafter referred to as “the Customer.”
ARTICLE 3. DEFINITIONS
“Customer”: any individual or legal entity, under private or public law, registered on the Website.
“Site Content”: any elements published on the Site, whether or not protected by intellectual property rights, such as text, images, designs, presentations, videos, diagrams, structures, databases, or software.
“Publisher”: Instruments du Monde, SAS, acting as publisher of the Website.
“Internet User”: any person, natural or legal, under private or public law, connecting to the Site.
“Product”: any item sold on the Website by the Publisher to Customers.
“Website”: the website accessible at the URL Instruments du Monde, as well as any sub-sites, mirror sites, portals, and variations of the URL related thereto.
ARTICLE 4. SCOPE
The Site is freely accessible to all Internet Users. By browsing the Site, you agree to this shipping policy. Simply connecting to the Site, by any means, including through a robot or a browser, constitutes full and complete acceptance of this shipping policy. When you sign up on the Site, you’ll confirm your agreement by checking the corresponding box.
By checking the box, you confirm that you have read, understood, and accepted this policy without restriction.
Checking the above box will be considered equivalent to a handwritten signature by the User. The User acknowledges the evidentiary value of the Publisher’s automatic recording systems and, unless they can provide proof to the contrary, waives the right to challenge them in the event of a dispute.
This shipping policy governs the relationship between the parties to the exclusion of all other terms and conditions, including those of the User.
By accepting this shipping policy, Internet Users confirm that they have the required legal capacity to do so or, failing that, that they have obtained authorization from a guardian or conservator (if legally incapable), from their legal representative (if a minor), or that they hold a mandate if acting on behalf of a legal entity.
ARTICLE 5. DELIVERY
5.1. Delivery costs
Delivery or availability costs will, in all cases, be indicated to the Customer before any payment is made.
The delivery costs indicated on the Website are in Canadian dollars, including all taxes.
5.2. Delivery time
Your order will be shipped within two business days of the Publisher receiving full payment.
As an exception, the Publisher reserves the right to take an annual vacation period during which no orders will be shipped. For the year 2025, this period is set from January 20 to February 5 inclusive. We’ll notify customers of this holiday period via a banner at the top of the website and, at the time of payment, via a date for the resumption of deliveries.
As an exception, certain products sold by the Publisher are not shipped within the two-business-day period following receipt of full payment. These exceptions are mentioned directly on the relevant product page. For example, this may apply to instruments tuned to 432 Hz that are customized for the customer, with a customization period of 7 business days. The number of days shown on each product page always refers to business days.
Orders are delivered by La Poste, Chronopost, Colis Privé, DHL, FedEx, UPS, EMS, Yunexpress, and SFC within 3 to 14 business days from the shipment date for France, Belgium, Switzerland, and European Union member countries.
Orders are delivered by DHL, FedEx, UPS, EMS, and Yunexpress within 3 to 30 business days from the shipment date for other countries.
However, certain custom-made products or large order volumes may require a delivery time of more than 14 business days, without exceeding 30 days.
If delivery is not made on the specified date or within the specified period—or, if neither is provided, no later than thirty days after the contract is concluded—you may instruct the Publisher in writing to complete the delivery or service within a reasonable additional period. If the Publisher still hasn’t complied within this new period, the Customer may request, again in writing, the termination of the contract. This becomes effective as soon as the Publisher receives the written request, unless the Publisher has complied in the meantime.
However, the circumstances surrounding the signing of the contract or an express request by the Customer may make the date or deadline an essential condition of the contract. If the Customer does not receive delivery by this date or within this period, they may immediately terminate the contract (Article L. 216-2 of the same Code).
5.3. Damaged package
If a package arrives visibly damaged, please refuse delivery so that the carrier’s warranty applies. Please notify us right away so we can prepare and ship a replacement as soon as the damaged package is returned. In such cases, the original delivery times stated above will not apply.
5.4. Retention of title - transfer of risks
Ownership of the Products delivered remains with the Publisher until delivery of the Products to the Customer, notwithstanding any clause to the contrary, unless the parties have specifically and expressly agreed in writing to waive this clause.
The Customer bears the risks relating to the Products from the time of order. Throughout the period of retention of title, the Customer must insure the Products belonging to the Publisher, at their own expense, against any damage that may occur and provide proof of such insurance to the Publisher upon first request.
ARTICLE 6. FINAL PROVISIONS
6.1. Applicable law
This shipping policy is subject to French law.
6.2. Modifications to this shipping policy
This shipping policy may be modified at any time by the Publisher. The shipping policy applicable to the Customer is that in force on the day of their order or connection to this Site, with any new connection to the personal space implying acceptance of the new shipping policy, where applicable.
6.3. Disputes
Pursuant to Order No. 2015-1033 of August 20, 2015, any disputes with a consumer Customer that may arise in connection with the performance of these general terms and conditions and for which no amicable solution can be found between the parties must be submitted to the online dispute resolution platform.

Since January 1, 2016, mediation has been mandatory for everyone. Thus, any professional selling to individuals is required to provide the contact details of a competent mediator in the event of a dispute, regardless of whether they sell remotely or in a physical store (Source: FEVAD).

6.4. Entirety
The invalidity of any clause in this contract shall not invalidate the other clauses of the contract or the contract as a whole, which shall remain in full force and effect. In such a case, the parties shall, as far as possible, replace the invalid clause with a valid clause that corresponds to the spirit and purpose of this contract.
6.5. Non-waiver
The Publisher’s failure to exercise the rights granted to it herein shall in no way be construed as a waiver of such rights.
6.6. Telemarketing
The Customer may register on the cold-calling opposition list at http://www.bloctel.gouv.fr/.
6.7. Languages of this shipping policy
This shipping policy is available in French.
6.8. Unfair terms
The provisions of this shipping policy apply subject to compliance with the mandatory provisions of the Consumer Code concerning unfair terms in contracts concluded between a professional and a consumer.
