"Site Content": any elements published on the Site, whether or not protected by intellectual property rights, such as text, images, designs, presentations, videos, diagrams, structures, databases, or software.

"Publisher": Instruments du Monde, SAS, acting as the publisher of the Website.

"Internet User": any person, natural or legal, under private or public law, connecting to the Site.

"Product": any item sold on the Website by the Publisher to Customers.

"Website": the website accessible at the URL Instruments du Monde, as well as any sub-sites, mirror sites, portals, and variations of the URL related thereto.

    ARTICLE 4. SCOPE OF APPLICATION

The Site is freely accessible to all Internet Users. Browsing the Site implies acceptance of this shipping policy. Simply connecting to the Site, by any means whatsoever, including via automated means or a browser, constitutes full and complete acceptance of this shipping policy. When registering on the Site, this acceptance is confirmed by checking the corresponding box.

By checking this box, the Internet User acknowledges having read this policy in full and accepts it without restriction.

Checking the above box will be considered equivalent to a handwritten signature by the Internet User. This shipping policy applies to relations between the parties to the exclusion of all other conditions, including those of the Internet User.

Acceptance of this shipping policy requires that Internet Users have the necessary legal capacity to do so or, failing that, that they have the authorisation of a guardian or conservator if they are incapacitated, their legal representative if they are a minor, or that they hold a valid authorisation if they are acting on behalf of a legal entity.

    ARTICLE 5. DELIVERY

    5.1. Delivery costs

Delivery or availability costs will, in all cases, be indicated to the Customer before any payment is made.

The delivery costs indicated on the Website are in euros, including all taxes.

Any customs duties and import taxes are paid by the Publisher: the Customer will not be charged anything on delivery.

    5.2. Delivery time

Orders will be shipped within 2 working days of full receipt of payment by the Publisher.

As an exception, the Publisher reserves the right to take an annual holiday period during which no orders will be shipped, except for digital books. For the year 2026, this period has been set from 7 to 22 February inclusive.

Orders are delivered with tracking within 2 to 14 working days of dispatch to Ireland.

However, certain custom-made products or order volumes may require a delivery time of more than 14 working days, without exceeding 30 days.

In the event of non-delivery by the specified date or within the specified time frame or, failing that, no later than 30 days after the contract is concluded, the Customer may instruct the Publisher, in writing, to deliver the goods or provide the service within a reasonable additional period. If the Publisher fails to perform within this new period, the Customer may request, again in writing, termination of the contract. Termination becomes effective as soon as the Publisher receives the Customer's written request, unless the Publisher has performed in the meantime.

However, the circumstances surrounding the signing of the contract or an express request by the Customer may make the date or deadline an essential condition of the contract. If the Customer does not receive delivery by that date or within that time frame, they may terminate the contract immediately (Article L. 216-2 of the same Code).

    5.3. Damaged package

If a package arrives visibly damaged, the Customer must refuse delivery to benefit from the carrier’s guarantee. The Customer must also notify the seller without delay so that a replacement package can be prepared and shipped as soon as the damaged package has been returned. In such cases, the delivery times indicated above in these general terms and conditions will no longer apply.

5.4. Retention of title - transfer of risks

Ownership of the Products delivered remains with the Publisher until the Products are delivered to the Customer, notwithstanding any contrary clause, unless the parties have specifically and expressly agreed in writing to waive this clause.

The Customer bears the risks relating to the Products from the time of order. Throughout the period of retention of title, the Customer must insure, at their own expense, the Products belonging to the Publisher against any damage that may occur and provide proof of such insurance upon the Publisher’s first request.

Risk of loss. Title and risk of loss for all products pass to you upon the carrier's confirmed delivery to the shipping address you provided at checkout. Please ensure your shipping address is complete and accurate; we are not responsible for orders sent to an incorrect or outdated address entered by the customer.

Proof of delivery. Carrier tracking marked "delivered," including any GPS data, delivery scan, or delivery photo, serves as confirmation that your order was delivered.

Packages marked delivered but not received. If tracking shows your order as delivered but you have not received it, please: (1) check around your property and with neighbors or building management; (2) contact us within 3 business days of the delivery date; and (3) if you believe the package was stolen, file a report with your local police and open an investigation with the carrier to resolve the situation.

Lost in transit. If an order is lost before being marked delivered, contact us and we will file a carrier claim and reship or refund your order.

This shipping policy may be modified at any time by the Publisher. The shipping policy applicable to the Customer is that in force on the day of their order or connection to this Site, with any new connection to the personal account constituting acceptance, where applicable, of the new shipping policy.

    6.3. Disputes

Pursuant to Order No. 2015-1033 of 20 August 2015, any disputes with a consumer Customer that may arise in connection with the performance of these general terms and conditions, and for which no amicable solution can be found in advance between the parties, must be submitted.

    6.4. Entirety

The invalidity of any clause in this contract shall not invalidate the other clauses of the contract or the contract as a whole, which shall remain in full force and effect. In such a case, the parties shall, as far as possible, replace the invalid clause with a valid clause that corresponds to the spirit and purpose of this contract.

    6.5. Non-waiver

The Publisher's failure to exercise the rights granted to it herein shall in no way be construed as a waiver of such rights.

    6.6. Telemarketing

The Customer may register on the no-call list at http://www.bloctel.gouv.fr/.

6.7. Languages of this shipping policy

    ARTICLE 7. SHIPPING & RETURNS

Article 7.1. Shipping conditions specific to the store

All orders are dispatched within 48 working hours. Delivery is free on orders totalling €99 or more.

Article 7.2. Delivery to a Pickup Location

The Customer is hereby informed that the Publisher does not offer delivery to a pickup point. The Customer must provide a personal address where they will be able to receive the package directly. Therefore, the Customer is not permitted to provide the address of any pickup point as the delivery address, as the designated carrier will not hand over the package to the manager of the designated pickup point. In the event that the Customer provides a pickup location address as the delivery address, the Publisher shall in no event be liable for any delayed or lost delivery by the carrier. Furthermore, if a second delivery is required due to the failure of the first, the Customer will be billed for the second delivery at the carrier’s rate.
